Welcome to Boots on the Ground (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and our boots-on-the-ground scouting services provided in the State of Colorado, New Mexico and Wyoming (the “Services”).

By accessing our website or purchasing our Services, you agree to be bound by these Terms. If you do not agree, do not use our website or Services.

1. Description of Services

Boots on the Ground provides boots-on-the-ground scouting and planning services in Colorado, New Mexico, and Wyoming, which may include, but are not limited to:

  • Physical site visits

  • Visual inspections and observations

  • Photo and/or video documentation

  • Written reports based on observed conditions

All Services are observational in nature and are performed based on conditions present at the time of the visit.

2. No Professional Advice

Our Services do not constitute legal, real estate, engineering, environmental, surveying, appraisal, or other professional advice.

  • We do not guarantee accuracy beyond what is reasonably observable.

  • We do not guarantee that our services will lead directly to a harvest.

  • Our reports reflect conditions at the time of the visit only.

  • You should not rely on our Services as a substitute for licensed or certified professionals.

3. User Responsibilities

By using our Services, you agree that:

  • You are legally authorized to request scouting services for the specified location.

  • Any information you provide is accurate and complete.

  • You are responsible for verifying results with appropriate professionals when necessary.

You acknowledge that access limitations, weather, terrain, third-party restrictions, or safety concerns may affect the scope of Services.

4. Scheduling, Fees, and Payments

  • All fees are disclosed prior to service confirmation.

  • Payment is due in advance unless otherwise agreed in writing.

  • Scheduling is subject to availability, weather, and safety conditions,

  • We reserve the right to reschedule or cancel services when conditions make performance unsafe or impractical.

Refunds, if any, are issued at our sole discretion based on work completed and expenses incurred.

5. Assumption of Risk

You acknowledge that boots-on-the-ground scouting involves inherent risks, including but not limited to:

  • Weather conditions

  • Uneven or hazardous terrain

  • Wildlife or environmental hazards

  • Access limitations

You agree that Boots on the Ground is not responsible for risks beyond our reasonable control.

6. Limitation of Liability

To the maximum extent permitted by Colorado law:

  • Boots on the Ground shall not be liable for indirect, incidental, consequential, or special damages.

  • Our total liability for any claim related to the Services shall not exceed the amount paid by you for the specific Service giving rise to the claim.

This limitation applies regardless of the legal theory asserted.

7. Indemnification

You agree to indemnify and hold harmless Boots on the Ground, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your unauthorized request for scouting services

8. Intellectual Property

All content on our website and all reports, photos, and materials provided by us are owned by Boots on the Ground unless otherwise stated.

You may use delivered materials for personal or internal business purposes only. You may not resell, distribute, or publicly display them without our written consent.

9. Privacy

Your use of our website and Services is also governed by our Privacy Policy, which explains how we collect and use information.

10. Termination

We reserve the right to refuse or terminate Services at any time for any reason, including safety concerns, misuse, or violation of these Terms.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any legal action arising from these Terms or the Services shall be brought exclusively in the state or federal courts located in Colorado.

14. Hunt Outcome Disclaimer (No Guarantee of Results)

Boots on the Ground provides scouting and observational services only. No guarantees, representations, or warranties are made regarding:

  • Animal sightings

  • Animal presence or movement

  • Hunt success or harvest outcomes

  • Shot opportunities or animal behavior

You acknowledge that wildlife is inherently unpredictable and that no scouting service can guarantee results. The success or failure of any hunt is solely the responsibility of the client.

The absence of animals, lack of activity, or unsuccessful harvest during a hunt shall not constitute a failure, breach, or deficiency in the Services provided.

15. Waiver, Release of Liability, and Assumption of Risk

Assumption of Risk

You understand and acknowledge that scouting, hunting, and outdoor activities involve inherent and known risks, including but not limited to:

  • Weather changes and extreme conditions

  • Rugged, uneven, or hazardous terrain

  • High elevation and physical exertion

  • Wildlife encounters

  • Remote locations with limited medical access

You voluntarily and knowingly assume all risks, both known and unknown, associated with the use of the Services and any subsequent hunting activity.

Release and Waiver

To the maximum extent permitted by Colorado law, you hereby waive, release, and discharge Boots on the Ground, its owners, officers, employees, agents, and independent contractors from any and all claims, demands, causes of action, or liabilities arising out of or related to:

  • Failure to locate, observe, or pattern animals

  • Failure to harvest

  • Reliance on scouting reports, photos, videos, GPS pins, or recommendations

  • Changes in animal behavior, pressure, or habitat conditions

  • Any injury, loss, or damage occurring during or after the hunt

This release applies whether such claims arise from negligence, contract, or any other legal theory, except where prohibited by law.

16. Time-Sensitive and Observational Nature of Services

You acknowledge that:

  • All scouting information reflects conditions only at the time of observation.

  • Wildlife movement, pressure, and behavior may change immediately after scouting is completed.

  • Weather events, hunting pressure, predators, human activity, or seasonal changes may render scouting information outdated.

Boots on the Ground makes no representation that scouting results will remain accurate or applicable at the time of your hunt.

17. Client Acknowledgment and Electronic Acceptance

By purchasing or using the Services, you affirmatively acknowledge that:

  • You have read and understood these Terms, including all waivers and disclaimers.

  • You understand that the Services are not outcome-based.

  • You accept that no refunds or damages are owed due to unsuccessful hunts, lack of animal sightings, or unmet expectations.

Your acceptance of these Terms via the website, electronic checkbox, invoice payment, or digital signature constitutes a legally binding agreement equivalent to a handwritten signature.

18. Standalone Waiver and Pre-Service Agreement

Boots on the Ground reserves the right to require clients to execute a separate, standalone Waiver and Release of Liability prior to the performance of any Services.

Failure or refusal to sign such waiver may result in denial of Services without refund.

In the event of any conflict between this Terms of Service and a standalone waiver, the standalone waiver shall control to the extent permitted by law.
